Maxym Health Virtual Care and Electronic Communication Consent

Consent for Use of Virtual Care Tools and Electronic Communications

I confirm that I have thoroughly reviewed and understand the associated risks, limitations, conditions of use, and instructions for the electronic communication and storage services provided by Maxym Health Inc. This includes, but is not limited to, the Maxym Health virtual care web application, email (both encrypted and unencrypted), video conferencing tools (both encrypted and unencrypted), and other forms of electronic communication (collectively referred to as the “Maxym Health Platform”).

The details of these services are outlined in this notice and Maxym Health's Terms of Use and Privacy Policy, and they pertain to the communication and storage of my personal information, including health-related details such as symptoms, diagnoses, test results, and treatment plans. I acknowledge and accept the risks associated with using the Maxym Health Platform and electronic communications with Maxym Health physicians, nurse practitioners, and other authorized healthcare professionals (“Authorized Healthcare Professionals”). I agree to adhere to the conditions and instructions specified in this notice and any additional conditions set forth by the Authorized Healthcare Professionals.

I understand that while encryption is recommended to enhance security when communicating via email, Authorized Healthcare Professionals may respond to me through unencrypted email if I opt for email communication. This presents heightened risks, as outlined below.

I am aware that either I or the Authorized Healthcare Professional can withdraw the option for electronic communication at any time by closing my account, ending the consultation, or providing written notice.

All my questions have been addressed. Should I have further inquiries or concerns regarding the handling or storage of my personal information on the Maxym Health Platform, I understand I can review Maxym Health's Privacy Policy or contact the Maxym Health privacy@Maxyhealth.com

I acknowledge that if I choose to receive my prescription from a Maxym Health pharmacy network, it may be dispensed by Compounding Specialty Inc., located in mississauga, Ontario.

Risks Associated with Virtual Care Tools and Electronic Communication

Although Authorized Healthcare Professionals will make reasonable efforts to protect the security and confidentiality of information transmitted via the Maxym Health Platform, complete security cannot be guaranteed due to the following risks:

  • Sensitive information communicated electronically may be disclosed to unauthorized third parties
  • Complete security of information transmitted through the Maxym Health Platform cannot be assured
  • Employers and online services might have the legal right to monitor and retain electronic communications
  • Electronic communications can introduce malware or disrupt computer systems and networks
  • Backup copies of electronic communications may persist even after deletion
  • Electronic communications may be disclosed in compliance with legal obligations or court orders
  • Email, particularly unencrypted, can be misdirected or intercepted and may be falsified or spoofed

Conditions for Using the Maxym Health Platform

  • The Maxym Health Platform is not suitable for emergencies or urgent matters
  • If you do not receive a timely response to your electronic communication, it is your responsibility to follow up to confirm receipt and response time
  • Electronic communication is not a substitute for in-person consultations or clinical examinations, nor for emergency care. You should seek emergency assistance or follow-up care as needed
  • Electronic communications may be included in your medical record, which may be accessed by authorized personnel involved in your care
  • Authorized Healthcare Professionals may forward communications to staff involved in your care but will not share them with unauthorized third parties without your consent, unless required by law
  • You should notify the Authorized Healthcare Professional of any information you prefer not to be communicated electronically
  • Some functionalities within the Maxym Health Platform may be limited to educational or administrative use and not for therapeutic or clinical purposes
  • Technical issues with software or internet services are not the responsibility of the Authorized Healthcare Professional

Instructions for Communicating Using the Maxym Health Platform

  • Avoid using employer or third-party computers when possible
  • Conduct virtual care in a secure and private environment
  • Obtain consent before recording any virtual interactions
  • Notify the Authorized Healthcare Professional of any changes in your contact information
  • For urgent assistance or worsening conditions, do not rely on the Maxym Health Platform. Seek immediate care through appropriate channels like 911 or the nearest emergency facility
  • When using email for communication, include a clear subject line and your full name, review all communications for clarity, confirm receipt, and protect confidentiality with appropriate security measures

Scope of Healthcare Services

Maxym Health services are available only in Alberta, British Columbia, Manitoba, Newfoundland and Labrador, Nova Scotia, Ontario, Prince Edward Island, and Saskatchewan. Services may vary by province based on local telehealth regulations.

Authorized Healthcare Professionals may not have access to your complete medical record and cannot perform physical examinations. They rely on accurate self-reporting for medical history and symptoms. Results cannot be guaranteed, and services may be declined or discontinued based on the professional's discretion.

Certain symptoms are not eligible for virtual care services and should be addressed in person or through emergency services. For any prescriptions received, ensure proper usage by reviewing all information and consulting a licensed professional for any questions.

Compounding Specialty Inc. Consent to Use Virtual Care Tools and Electronic Communications

Consent for Pharmacy Services

I confirm that I have reviewed and understand the risks, limitations, conditions of use, and instructions for the electronic communication and storage services offered by Compounding Specialty Clarkson Pharmacy, including telephone consultations with pharmacists, email reminders (both encrypted and unencrypted), and other electronic communications as detailed in this notice and Maxym Health's Terms of Use and Privacy Policy.

I accept the risks associated with using the Maxym Pharmacy Network and/or Compounding Specialty Clarkson Pharmacy and electronic communications with Authorized Healthcare Professionals or Maxym Health Agents. I agree to comply with the conditions specified and any additional instructions imposed by the Authorized Healthcare Professionals or Maxym Health Agents.

I understand that despite recommendations for encryption, email communication with Maxym Health Agents or Authorized Healthcare Professionals or agents of Compounding Specialty Clarkson Pharmacy may involve unencrypted email, which carries additional risks.

I acknowledge that either I or the Authorized Healthcare Professional can withdraw consent for electronic communication at any time by providing written notice.

I acknowledge that prescriptions from the Maxym Health Virtual Care clinic may be dispensed by Compounding Specialty Inc. o/a Compounding Specialty Clarkson Pharmacy, in Mississauga, Ontario, and that I have the option to choose a different pharmacy if preferred.

Definitions

  • Authorized Healthcare Professionals: Licensed pharmacists and pharmacy technicians in Canada
  • Electronic Communications: Communications sent through telecommunication means, including texts, sounds, or images (encrypted or unencrypted)
  • Maxym Health Agents: Officers, administrators, and employees of Maxym Health and its pharmacy network supporting pharmacy services
  • Maxym Health Platform: Hardware, software, and services operated by Maxym Health for remote healthcare services
  • Maxym Pharmacy Network: Services and products provided by Compounding Specialty Clarkson Pharmacy
  • Personal Information: Information about an identifiable user as defined by applicable law, including personal health information
  • Pharmacy Services: Professional services provided by pharmacists or pharmacy technicians, including consultations and medication management
  • User: Individuals registered with Maxym Health to receive services
  • Virtual Care: Remote professional services using virtual tools
  • Virtual Care Tools: Technologies enabling remote communication, including teleconferencing and email

Risks Associated with Virtual Care Tools and Electronic Communication

  • Use of electronic communication can increase the risk of unauthorized disclosure
  • Complete security of information cannot be guaranteed despite efforts
  • Employers and services may have the right to access communications
  • Communications can introduce malware or cause system issues
  • Unencrypted communications are vulnerable to misdirection, interception, and alteration
  • Backup copies may exist even after deletion
  • Communications may be disclosed due to legal requirements

Conditions for Receiving Pharmacy Services

  • The Maxym Health Platform and Compounding Specialty Clarkson Pharmacy are not suitable for emergencies
  • Follow up if you do not receive a timely response
  • Virtual communication is not a substitute for in-person examinations or emergency care
  • Communications may be forwarded to those involved in your care but not to unauthorized third parties without consent
  • Inform the Authorized Healthcare Professional of any information you wish to exclude
  • Certain functionalities may be used only for non-clinical purposes
  • Technical issues are not the responsibility of the Authorized Healthcare Professional

Instructions for Communicating Regarding Pharmacy Services

  • Use secure and private devices for communication
  • Obtain consent before recording interactions
  • Inform the Authorized Healthcare Professional of any contact information changes
  • For urgent matters, seek immediate assistance through appropriate channels
  • When using email, include a descriptive subject line, review for clarity, confirm receipt, and ensure confidentiality

Scope of Pharmacy Services

Maxym Pharmacy Network services are available in specified provinces and may vary by location. Authorized Healthcare Professionals may not have full access to medical records and rely on accurate self-reporting. Services may be declined or discontinued based on professional judgment.
